Dear Construction Professional,
October 1999, the State of California passed a law (AB931) now part of the labor code Section 3099, that will require electricians to be certified and is currently proposing through AB-1087 to require that uncertified electrical workers be enrolled in a State Approved Apprenticeship Program. Additionally, another law (AB921) will make it difficult, if not impossible, for merit shop contractors to offer new, or maintain existing State Approved Apprenticeship Programs. These laws were introduced and supported by the I.B.E.W. and N.E.C.A., and the proposed rules to enact them could have a very negative impact on electrical contractors and all Merit Shop employees. In fact, the direction that this and other regulation is headed could result in a significant loss of jobs for your employees and will result Merit Shop Contractors, becoming less competitive in the market place. Lastly, the California Apprenticeship Council has approved a proposal to apply State public works prevailing wage rates to all wages paid to Merit Shop State Approved apprentices. This would affect ALL trades and private jobs! Apprentices in Union programs are exempt.
A group of concerned Merit Shop Electrical Contractors have formed a coalition
to encourage a change, or at least a compromise to these one sided proposals.
The coalition is called the Fair Licensing and Apprenticeship Coalition
(FLAC). Our supporters include Electrical Contractors, General and Specialty
Contractors, Business and Chamber of Commerce Associations, The mission
of FLAC is the preservation of equal opportunity and the fair licensing
of all construction workers. We need your help to gather facts and figures
that could help us when discussing the issues with legislators, lobbyists
and associations that would be affected by this law. We would also like
to solicit contributions to help fund our educational efforts and our ability
to protect our legal rights. A hotline has been established for interested
